ZELORA TERMS OF SERVICE
These Terms of Service (“Terms”) govern your access to and use of Zelora, a product of Zalen Ltd, a company registered in Kenya (“Zelora”, “we”, “us”, or “our”), including our website, applications, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
1. About Zelora
Zelora is a digital platform that enables users to:
- Create and manage memorial pages and digital eulogies
- Share tributes, messages, photos, videos, and audio
- Publish funeral or memorial event details
- Facilitate voluntary contributions for funeral-related purposes
- Participate in symbolic interactions such as virtual candle lighting
Zelora does not provide funeral, financial, legal, or advisory services.
2. Eligibility & User Accounts
2.1 Eligibility
- You must be at least 18 years old, or use the Services under appropriate supervision.
- By using Zelora, you confirm that you have the legal capacity to enter into these Terms.
2.2 Account Creation
- Accounts may be created using email, phone number (OTP), or supported third-party login services.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
3. Memorial Creation & Administration
3.1 Memorial Creation
- Any user may create a memorial without proof of kinship at the point of creation.
- Zelora does not verify whether a user is a next of kin or authorized representative.
3.2 Memorial Visibility
- Memorials may be public or private, as selected by the administrator.
- Public memorials may be accessible to anyone with a link or via the platform.
3.3 User Responsibility
You are solely responsible for:
- The accuracy, completeness, and truthfulness of memorial content
- Ensuring you have the right to upload photos, videos, or information
- Any consequences arising from public visibility of content
4. User-Generated Content
4.1 Ownership
You retain ownership of content you submit. By submitting content, you grant Zelora a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute such content solely for operating the Services.
4.2 Prohibited Content
You must not post content that:
- Is unlawful, defamatory, abusive, hateful, or misleading
- Impersonates another person
- Violates intellectual property or privacy rights
- Is intended to defraud or mislead contributors
Zelora may remove content at its discretion without notice.
5. Contributions, Payments & Candle Lighting
5.1 Third-Party Payments
- Zelora does not process or hold funds directly.
- All payments are handled by third-party payment providers.
- Zelora is not responsible for errors, delays, or failures caused by payment providers.
5.2 Contributions
- Contributions are voluntary and non-refundable unless required by law.
- Contribution visibility is private by default.
- Anonymous contributions may be enabled.
5.3 Candle Lighting
- Virtual candle lighting is a symbolic feature tied to voluntary contributions.
- Candle lighting may display contributor name (or anonymous status) and timestamp.
- Candle lighting does not confer ownership, authority, or financial rights.
6. Withdrawals & Verification
Users seeking to withdraw funds or manage contributions may be required to verify their identity. Verification may include:
- Government-issued identification
- Contact details of a relative or trusted representative
Zelora may suspend or restrict withdrawals until verification is completed. Zelora does not guarantee approval of withdrawals.
7. Disputes & Neutrality
In the event of disputes between family members, contributors, or administrators:
- Zelora remains neutral
- Zelora may temporarily restrict actions or access
- Zelora does not adjudicate family, inheritance, or ownership disputes.
8. Memorial Succession
If a memorial administrator is deceased, incapacitated, unreachable, or unable to manage a memorial:
- Zelora may reassign administrative control upon reasonable verification
- Zelora is not obligated to do so and may decline where disputes exist
9. Admin Access & Platform Support
Zelora administrators may access user accounts only for:
- Technical support
- Moderation
- Security
- Compliance
- Dispute handling
Administrators cannot initiate, approve, or execute withdrawals or financial transactions.
10. Reporting & Takedown
Users or third parties may report content they believe violates these Terms. Zelora reserves the right to:
- Remove content
- Restrict access
- Suspend or terminate accounts without prior notice
11. Data & Privacy
Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect personal data.
12. Suspension & Termination
Zelora may suspend or terminate your access if:
- You violate these Terms
- You misuse the platform
- Your activity poses legal, security, or reputational risk
You may stop using the Services at any time.
13. Disclaimers
- Zelora is provided on an “as is” and “as available” basis.
- Zelora does not guarantee uninterrupted, error-free, or secure operation.
- Zelora does not guarantee accuracy of memorial or obituary information.
- Zelora does not guarantee successful fundraising outcomes.
14. Limitation of Liability
To the fullest extent permitted by law:
- Zelora shall not be liable for indirect, incidental, or consequential damages
- Zelora shall not be liable for user-generated content
- Zelora shall not be liable for third-party payment failures
- Zelora shall not be liable for family or contributor disputes
- Zelora shall not be liable for emotional distress arising from content or interactions
15. Indemnity
You agree to indemnify and hold harmless Zelora, Zalen Ltd, and its officers, employees, and partners from any claims, losses, or damages arising from:
- Your use of the Services
- Your content
- Your violation of these Terms
16. International Use
Zelora may be accessed from outside Kenya. You are responsible for compliance with local laws applicable to your use.
17. Changes to These Terms
- Zelora may update these Terms at any time.
- Material changes will be communicated where appropriate.
- Continued use of the Services constitutes acceptance of the updated Terms.
18. Governing Law & Jurisdiction
These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.
